Cambs Ely Mortgages – Website Terms of Use & Client Hub Terms

These Terms set out the rules for using cambselymortgages.co.uk (the “Site”) and, where applicable, our member-only Client Hub (the “Hub”). Please read them carefully. By using the Site or accessing the Hub you agree to these Terms.
If you do not agree, do not use the Site or Hub.
Who we are
Cambs Ely Mortgages is a trading style of CM Finance Limited t/a Custom Mortgages & Finance ("we", "us", "our"). CM Finance Limited is an Appointed Representative of Connect IFA Limited (FRN 441505), which is authorised and regulated by the Financial Conduct Authority. Regulatory scope
The FCA does not regulate some forms of Business Buy to Let Mortgages and Commercial Mortgages to Limited Companies.
1) What these Terms cover
Use of the public Site (information pages, blog, calculators, contact forms, booking pages).
Use of the Client Hub (secure area where you may view status updates and upload documents).
Important disclaimers about information on the Site and Hub.
Our intellectual property and your permitted use.
Acceptable use rules and restrictions.
Privacy and cookies (see also our separate Privacy & Cookie Policy).
Liability and governing law.
If you engage us for advice or brokerage, that relationship will be governed by additional documents (for example, our Initial Disclosure/Services & Fees document, our Terms of Business/Client Agreement, and a suitability/recommendation letter). Where there is a conflict, the engagement documents take priority for the advisory relationship.
2) Not advice – information only (and important risk warnings)
Content on the Site and Hub is general information. It is not personal advice. Mortgage and protection decisions depend on your circumstances; please contact us for tailored recommendations.
Rates, criteria and product features change frequently and may be withdrawn without notice. Information and tools (for example, calculators or eligibility checklists) are illustrative only and do not guarantee that you will be offered a product on those terms.
Mortgage warning: Your home may be repossessed if you do not keep up repayments on your mortgage or any other debt secured on it.
Protection disclaimer: Insurance cover is subject to terms, conditions, exclusions and underwriting. Always read policy documents and key facts/summary of cover.
Nothing on the Site/HUB is an offer, invitation or inducement to buy a regulated product. We only make recommendations after completing regulatory steps (e.g., fact‑find, needs assessment and disclosure).
3) Eligibility and geographic scope
The Site and Hub are intended for individuals and businesses resident in the United Kingdom. We do not represent that content is appropriate or available in other locations; you are responsible for compliance with local laws if you access the Site from elsewhere.
Regulatory targeting: The information contained within this website is subject to the UK regulatory regime and is therefore targeted at consumers based in the UK.
4) Access to the Site and Client Hub
We try to keep the Site and Hub available, but we do not guarantee uninterrupted or error‑free access. We may suspend, withdraw, or restrict availability for business or operational reasons.
You are responsible for ensuring that everyone who accesses the Site or Hub via your internet connection is aware of these Terms and complies with them.
To use the Client Hub, you must create an account or be provisioned with one. Keep your login credentials confidential; you are responsible for all activity under your account. Notify us immediately if you suspect unauthorised access.
We use commercially reasonable security measures for the Hub, but no online system is 100% secure. Do not upload information that is not necessary for your application or review.
5) Uploading documents and information
Where the Site or Hub allows you to upload or submit information (for example, ID documents, bank statements, insurance policies, property details):
You warrant that you have the right to share the material and that it is accurate, lawful and does not infringe any rights (including privacy and intellectual property).
Do not upload: malware, illegal content, payment card numbers, passwords, or other highly sensitive data not reasonably required for the service.
You grant us a non‑exclusive licence to use, store and share your submissions solely for the purpose of providing services to you, meeting regulatory requirements, and operating the Site/Hub. We will handle personal data in line with our Privacy Policy.
We may remove any upload that, in our reasonable opinion, breaches these Terms or the law.
6) Privacy and cookies
We will collect and process personal information in accordance with our Privacy Policy and Cookie Policy, which form part of these Terms. These explain what we collect, how we use it, the lawful bases, retention periods, your rights, and how to manage cookies. Please review them before submitting personal data.
7) Intellectual property rights
The Site and its content (text, graphics, logos, icons, images, video, design and code) are protected by copyright and other rights. Unless otherwise stated, we own or license all intellectual property in the Site and Hub.
You may view pages on-screen and print a reasonable number of pages for your personal use. Any other use (including copying, scraping, framing, systematic downloading, or creating derivative works) requires our prior written consent.
Third‑party trade marks (e.g., lender and insurer names/logos) are the property of their respective owners. Use on the Site does not imply affiliation or endorsement.
8) Acceptable use
You must not use the Site or Hub to:
break the law or infringe anyone’s rights;
upload or transmit malware or harmful code;
attempt to gain unauthorised access to the Hub or our systems;
harvest data or carry out automated scraping without consent;
impersonate another person or misrepresent your affiliation;
publish or upload defamatory, obscene, hateful or otherwise unlawful material.
We may suspend or terminate Hub access if you breach these rules.
9) Third‑party services and links
The Site or Hub may link to or integrate third‑party tools (for example: appointment booking, identity verification, cloud storage, e‑signature, analytics, payment services). These are provided by independent providers with their own terms and privacy policies. We are not responsible for their content, security or availability. Use of third‑party services is at your own risk.
10) Fees, commissions and conflicts of interest
Our fees
A fee will be payable for arranging your mortgage. Your consultant will confirm the amount before you choose to proceed. We usually charge a fee of £295 to £995. The precise amount will depend on your circumstances.
Commission disclosure (credit broking)
We are a credit broker, not a lender. We have access to an extensive range of lenders. Once we have assessed your needs, we will recommend lender(s) that provide suitable products to meet your personal circumstances and requirements, though you are not obliged to take our advice or recommendation. Whichever lender we introduce you to, we will typically receive commission from them after completion of the transaction. The amount of commission we receive will normally be a fixed percentage of the amount you borrow from the lender. Commission paid to us may vary in amount depending on the lender and product. The lenders we work with pay commission at different rates. However, the amount of commission we receive does not affect the amount you pay to that lender under your credit agreement.

We maintain procedures to identify and manage conflicts of interest. Details are available on request.
11) Complaints
It is our intention to provide you with a high level of customer service at all times. If you cannot settle your complaint with us, you may be entitled to refer it to the Financial Ombudsman Service: https://www.financial-ombudsman.org.uk.
12) Disclaimers and limitation of liability
The Site and Hub are provided on an "as is" and "as available" basis. We make no representations or warranties that content is accurate, complete, up to date or free from errors or omissions.
To the fullest extent permitted by law, we exclude all implied warranties and are not liable for any loss or damage arising from your use of, or reliance on, the Site or Hub (including loss of data, business, profits or savings), except where caused by our fraud, fraudulent misrepresentation, or negligence resulting in death or personal injury.
We will not be liable for failure to perform, or delay in performance of, any obligations caused by events outside our reasonable control.
Nothing in these Terms affects your statutory rights.
13) Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page with an updated effective date. If changes are material for Hub users, we may also notify you by email or in‑Hub notice. Your continued use of the Site or Hub after changes means you accept the updated Terms.
14) Termination
We may suspend or terminate your access to the Hub immediately if you breach these Terms or if we reasonably suspect misuse. You may close your Hub account at any time by contacting us. Termination will not affect rights and obligations that have already accrued.
15) Electronic communications
You agree that we may communicate with you electronically (via the Hub, email, SMS or other digital channels) for service and regulatory purposes. Please keep your contact details up to date and check your spam/junk folders.
16) Governing law and jurisdiction
These Terms, and any non‑contractual obligations arising out of or in connection with them, are governed by the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction (if you reside in Scotland or Northern Ireland you may also bring proceedings in your local courts).
